Section 52A of the Conveyancing Act 1919 and the Conveyancing (Sale of Land) Regulation 2005 put an obligation on the vendor to disclose prescribed information about the property (Being Statuatory Disclosure).
The Conveyancing Act 1919 prescribes documents that must be attached to the contract; those documents are set out in the Conveyancing (Sale of Land) Regulations 2005 and listed below:
- S .149 certificate (Zoning/planning certificate)
- Sewerage diagram
- Property certificate and plan for Real Property Act land
Strata title documents
- Property certificate for the lot and common property
- Copy of the strata plan
- Copy of any By-Law for the strata scheme to which Division 4 of Part
Strata leasehold documents
- Property certificate for the leasehold estate in the lot
- Property certificate for the leasehold estate in the common property
- Copy of the strata plan that shows the lot
- Copy of the registered lease of the lot and the registered lease of the common property
- Copy of any By-Law for the strata scheme to which Division 4 of Part
5 of Chapter 2 of the Strata Schemes Management Act 1996 applies
- Strata management plan - of the Strata Schemes (Freehold Development) Act
- Building Management Statement
- Strata development contract - staged strata developments
Community title - community scheme
- Property certificate for the lot and common property
- Copy of the community plan and copy of community management statement and any development contract
- Community title - precinct scheme, neighbourhood scheme, Strata
